Sellers not providing a fixtures and fittings list

Good evening,
We are in the final stages of out purchase and we have now been told the seller isn't going to provide a fixtures and fitting list as they are selling on behalf of a dead relative.
I have said I want the house clearing of appliances, but I am now worried they will go overboard and take carpets and light fittings.

Am I in my right to insist on a list?

  • They can say that place is sold as seen. If you don't want some of their things - e.g. cookers are heavy things to get rid of - then your solicitors can require them to be removed. All a matter of negotiation.

    If you think they may leave the place a mess then you need to keep an eye on the property and go round first thing on the morning of completion to see if it is clear before your solicitors send the money - afterwards it is difficult to do much about it.

    It is normal to provide a fixture and fittings list and for both buyers and sellers to agree to its contents and if any money is being paid for any of the items on the list.

    My solicitor would not let us complete without the list. When i went to the last visit before completing i blatantly asked what they were going to leave or take.
    In the end they lied & took a gas heater, my solicitor got a substantial amount back from the seller, as they argued there was no way we knew whether the removal was safely done or not (it had been capped).
    No one said it was gonna be easy!
  • The house is mostly empty, just a few things dotted around such as a freestanding oven and old washing machine. I've told my solicitor I want it clearing. I'm just uneasy about not knowing if they will go overboard

    Talk to your solictor again to get some reassurance / advice - that's what you're paying them for! Legally your vendor must leave some form of light fittings anyway.
