    Optima Legal is the worse that can happen to anyone!

    Forget about them making any sense of things, they are not competent enough and have far too much in their hands than they can handle. If you are forced in this position I would say that you take a legal action against them as soon as possible with all the evidence.

    PS - I will not be able to pay for your Legal Battle :)

    The notice says if you make a payment to clear arrears and does not show on the account for any reason, then let someone be at the property with proof of payment to show when an eviction is enforced. In my case, my wife had proof yesterday, but the eviction team refused and went ahead. In the past months have also sent payments via bank transfer abroad, some of these payments are not on my statement. Where do I go to start this legal battle? any suggestion?

    You are unlikely to be able to mount a legal defence whilst on a health sabatical in Africa.

    I do not want to give you false hope, I think a realist would say this is unlikely now...

    Thanks for all the advice. I challenged the eviction in court abd tge lender did not oppose. My family moved back in but the following happened;

    1. The lender has entered the property twice to do an evaluation even though we left all our personal belongings inside.
    2. The lender attempted to fix 2 toilets sits that was loose even though we indicated that we were challenging the eviction

    My solicitor has asked me to make a claim for the consequences of eviction me when they should'nt. If I decide to claim, what are the thing i can cite and how much can I claim?

    I would cite that you left you family in a home that you did not pay the mortgage on. Furthermore you let the matter get a few days from court before you finally paid the arrears, whilst on your jollies in Africa.

    In addition to this you now want to have a claim up.

    If this is the truth and I am not sure, live in the house, pay your mortgage and keep reminding yourself how lucky you have been..
