My House has been repossesed

Today, my house was repossessed by Accord having been granted a court order. I'm away in Africa on medical ground for the past one year and a half.

The total amount oweing as of yesterday was £6700. I made a payment of £3000 yesterday, another payment of £1100, before the 12:00 today clock deadline. I also made a transfer of £3800 yesterday but the mortgage company are claiming that this money arrived after the 12:00 deadline. In the morning till mid day today i continously called Accord advising them that a bank transfer amounting to £3800 was made yesterday. I emailed Optima legal the payment proof of £3800 in the morning. I made another payment for £ 3800 by cards and now as it stand, the outstanding balance has been cleared. I have over paid by £3800. The mortgage company evicted my wife and children in the afternoon and are now claiming that i pay the full mortgage amount to get my house back. Can you please assist if there are way that can help get my house back? Please help

    Whatever the reason for you being in Africa and unable to return to the UK. Non-attendance at the Court Hearing would not have helped your cause.

    I'm surprised that the eviction happened so quickly after the Court case. Normally repossession is sought first. The Court then normally allows 14 days before eviction is effected.

    Would appear that you left the matter far too late.

    Thrugelmir, you are right the notice was issued 14 days ago. I was business looking for money and today I managed to pay the full amount. Is there a way I can get this sorted out.... county court or high court to get my family back into the house?

    Is the mortgage in your name only or joint with wife?

    Surely the paperwork was sent to the home address for the court date whether in your name or joint?

    and the repossession hearing?

    Eviction hearing is more or less a rubber stamping exercise.

    Then your wife will have signed an Occupier's Consent form when the mortgage was taken out meaning she has signed away any rights in favour of the lender's right to repossess. As it is a sole mortgage in your name then she would not be requested to attend court.

    Agree with other posters, something not quite right here. Full story not being told, or a wind up.
