Mis sold flooring

Hi , First time posting here so.....Sorry if this is in the wrong place. I recently purchased some laminate floor of a AC5 grade. When the floor arrived it was of a lesser grade AC3. I emailed the supplier and got no response so I phoned them a couple of days later. They said that if I wanted AC5 grade I would have to pay more. Is this correct ? Surely as they have advertised this incorrectly they should offer to replace it to the AC5 grade that I ordered for no extra charge. So far they only offered a £60 reduction in price. I paid over £600 for the floor.

Read the information above. Keep all correspondence. Have you invoices etc. Ask nicely for your money back as you have not received the goods you have paid for. If paid by card do section 75 charge back. Then money claim online .Do you want your money back, and a bit more, search for 'money claim online' - They don't like it up 'em Captain Mainwaring0

I have Kept a screen shot of there website as when I spoke to them they changed it immidiatly. Unfortunatly I paid with Debit card....DOH ! . Thanks for the responce0 -
Is the floor fitted or still in the boxes?
If you fitted it after noticing that it was a different type of floor then thats your own fault and I don't believe they have to replace the floor with the higher grade one. You may be able to return it but I would think you are on dodgy ground as you identified it was the inferior floor before fitting it.
If its still in the box then you can return it and get a refund. However they don't have to sell you the more expensive floor at the price you originally saw.

I noticed just after the driver had gone, all still in boxes. Essentially they advertised it as the higher grade incorrectly, they have had the monies and delivered a lower grade. My thinking was they should honour the purchase and swap for the correct floor and swallow any price increase...... I guess the best I can expect is a refund. Is it a case for trading standards ? ?0

Nope, they have to leave you in the position you were before the contract. That's all they legally have to do.
They should collect the items free of charge or refund you for any charges in getting the item back to them.
Nothing else you can do unfortunately.0 -

It doesn't make any difference whether the OP is a business or a consumer.
The SOGA applies to B2B contracts as well as B2C ones. it's just that there are some additional rights for consumers.
The relevant part of the SOGA is section 13 & there is no stipulation that this section is only for consumer contracts.0
