We were told by Payplan and Stake your Claim that any fees due would be put back into the DMP arrangement? This is factually accurate?DMP # 280

Lucy- simple answer is claim the money back yourself. Using the questionaire from this site. When/ if you win your claims use the money to pay off towards your debts. Why are you wanting to pay a company to do it for you?0

This is an old thread which has been bumped up. Lucy5781 hasn't visited the site since she told forum members to get over themselves back on October 12th.getinmyselfoutadebt wrote: »Lucy-0 -

From the start Payplan and SYC advised us that the fees would be absorbed into the DMP and therefore SYC would be become another creditor as such. One of the creditors has settled but is redressing the debt / arrears. Any third party fees owed must be met by myself (the creditors policy)
Are third party fees owed absorbed into a DMP as standard practice for example or each case bespoke?
Whilst the debt reduction is a win win, having to pay 1K up front to SYC is not going to happen (so this leaves me where!)

I have checked this and found that these companies have five common directors and there is a clear conflict of interest and Payplan ought to know how easy a DIY complaint is because, as a holder of a Consumer Credit Licence, it falls under exactly the same rules as those dealing with complaints about PPI.
So in other words they have deliberately caused you to incur an additional, and unnecessary debt from which those directors stood to benefit.
I recommend you send the following letter.
Send it first class and get proof of posting (free from the Post Office).
In theory, you could complain to SYC but although it comes under the jurisdiction of the Legal Ombudsman this year, Payplan is already under FOS jurisdiction.

Dear Sirs
Account number [number] - Complaint
I am writing to make a formal complaint that Paypal Limited failed to act in my best interest by referring me to Stake Your Claim Limited to pursue a claim against [name(s) of firms] in relation to Payment Protection Insurance.
Although this resulted in a payment of £[amount] which has been able to be used against my debts, it has also resulted in an additional debt of £[amount] in favour of Stake My Claim Limited.
I have now learned that you are all directors of both companies and that, as a holder of a Consumer Credit Licence, Paypal Limited is subject to exactly the same dispute resolution rules as any firm addressing a Payment Protection Insurance complaint
You therefore know, or ought to know, that those rules require any firm receiving a complaint to acknowledge it promptly and to issue a final written response within eight weeks or a written explanation of how the complaint of why more time is needed. In either case, the firm must explain how the complaint can be referred, free of charge, to the Financial Ombudsman Service and enclose a copy of the booklet "Your Complaint and the Ombudsman".
The firm may not charge the complainant for investigating the complaint. Nor can penalise or take any retaliatory action against a person making a legitimate complaint against it.
I therefore put it to you that by referring me your other company without making clear to me that I could easily do this myself, you each failed to act in my best interests or to properly manage a conflict of interest that must have been obvious to you.
Accordingly, I wish you to treat this matter as a formal complaint against Payplan Limited.
Yours faithfully

I used the stake your claim company via my payplan...won over 6k back, cleared the dmp and ended up with money in hand...i know i could have done it myself and have since done further ppi claims myself, but this was an easy option on a dmp and am fully happy to be finally debt free.Proud to be DEBT FREE AT LAST0

I had Stake Your Claim investigate on my behalf if I had PPI on any of my debts.
Unsurprisingly, as I assumed, I had specifically refused any PPI on any applications where the offer was made and was not signed up for it anywhere else.
So, nothing lost. Even sent my forms back to them via my work's post, so no cost to me at all.
Has been good to eliminate the possibility of having unclaimed funds.
Thank you all for continuing to argue on this thread in the months since I last posted on it.
