Hi i just gone onto esa from jsa because i had carpal tunnel surgery so i cant work for 3 weeks.
i also get dla lower rate.
is it true ill lose my dla premuim on esa.
so ill just get the basic rate. ill lose about £30 a week
should i go back onto jsa.
i cant work for a few weeks.
i do like the idea of getting extra help as i do have some learning dificulties

DLA is not linked to ESA - apart from being paid by same department, so no you should not lose any DLA.
ESA - works as follows - Assessment rate is paid for 13 weeks and during that time you get the same as you got on the JSA. You must supply what is called a fit note now(sick note) from your GP and send it to the DWP before the end of the current one or the benefit will not be paid. I would suggest that you try and get one for the whole 3 months if you can. Keep a copy in case the original gets lost. It happens.
Eventually - you will get sent an ESA50 to complete and return. This will be what triggers the medical carried out by ATOS. But it may never get to that stage as you say you are expecting your hand/wrist to be better within that time frame. However, if you problem is not healing as well as it should and that can happen with some things, then complete that form and go on from there with another fit note until you do get called for that medical.0 -
but now im on less money. then i was on jsa plus dla premium. so for 3 months im expected to lose out on £120..0

correct whilst on assessment rate of esa it will not include any long term illness element its just basic rate of esa.
how long will you know if the surgery was a success? i have carpel tunnel in my right and left hand, my right hand being the worse for wear, i have not had any injections yet but from what GP said i should be in for surgery as it passed that stage of trying to free up the tendens.
the risk is that one mistake to the nerve near the carpel site can lose the whole feeling to the half of the hand. ive heared a few reports that after 6 weeks somepeople still have limited movement and feeling and have to go through more pysio therepy.
there is no harm in asking your work focused agent at your JCP to aid finding you or part funding a learning scheme.0 -
i had my carpal tunnel surgery a week on thursday. i have carpal tunnel in both hands but got the left one done first. . i might have the other hand done in 3months, the op is really easy. the worst part was the needle to numb the hand then i didny feel a thing.. good luck. i have to go back to my gp in a month to get it checked,
so am i better off going back onto jsa,0 -
i know your down on money, but factor in the time scale to fully heal the possability of another operation to the other hand.
ask your GP whether he thinks youll be fine to seek and work or whether you should give yourself the time to heal. he's the one providing you with fit notes.0 -
so due to no fault of my own ill lose £120 a month for 13 weeks because i cant work for a month.

What rates of DLA are you getting?

Medium or high-rate care award may trigger extra premiums, which would be payable during the assessment period.0 -

I had thought the premiums for JSA and ESA were similar.
Though I have not checked the detailed guidance, http://www.disabilityrightsuk.org/f46.htm#Disability indicates that the disability premium (of 30/week) is payable for 'just' having an award of any rate of DLA.
http://www.disabilityrightsuk.org/f31.htm - this is the similar document for ESA - and as I thought, you need mid-rate care (or support group) to trigger any premiums.
I guess the idea is that the support or work-related component (payable after 13 weeks) takes the place of the disability premium in JSA, to take someone disabled back to about the same money.
This does unfortunately raise the issue above.
There is no reason you can't claim JSA, if you are able to perform some work, and can negotiate an appropriate jobseekers agreement.0 -

That's not quite true, DLA use your ESA assessment as evidence to base yor DLA claim on..
My ESA assessment was 5 months before my DLA claim was submitted they state on the DLA paperwork that they use the notes from ATOS..I always take the moral high ground, it's lovely up here...0
