how legal is "full and final settlement"

    You've done what is morally spot-on, but in breach of your insurance T's & C's.

    Expect a lot of spite & oneupmanship on this forum that you'll have to sift through to find sensible legal advice.

    I can't offer any legal advice, but from personal experience (just got back 4 years NCB for my partner after a two year palaver over being driven into by a drunk old fart on a roundabout); just keep complaining, keep plugging it away and keep raising it to the next level.

    Protected ncd or not, if you followed the correct procedure and informed your insurance company of the accident even for information purposes only and even if you weren't at fault, they would look at you as an increased risk come renewal time. The terms of your insurance will state that you must inform them of any incidents.Not judging by the way because I've done this myself in the past but it can be a risk and come back to bite you.

    I just wanted to thank Tobster86.

    I didn't even realise I had done something wrong until today. I have been hounded by lots of these claims companies so I agree that this guy is definitely chancing his arm.

    I've been worried all afternoon since I posted... until I read Tobster86 post...

    You would think I had hit and run or just fobbed the guy off... I did pay him for his damage. (And I only hit him because we slid on ice, I recon it was 60:40 my fault !)
