Almost £9000 reclaimed

Hi to all. I am not much of a blogger so I may be posting this all wrong. But here goes anyway. I would like to report a successful claim with one letter template from MSE and one phone call from the bank of just under £9000. That the good part. I would also like some advice as a few strange things happened during the phone call and the follow up letter from the bank was awarding the refund. Here is what happened. About a week after my claim went in I received a phone call from the bank to discuss the claim. This put me at a disadvantage as I was at work and did not have a copy of the claim with me. I played it cool and said that as I did not have a copy with my and I did not want to contradict anything verbally that I may have put in my claim I just referred him back to my submitted claim.
During the talk the bank rep referred to another (earlier) loan that I had not as yet claimed on but intended to. I thought this a strange thing for him to do as I had not made any claim against this loan. When the letter arrived from the bank with the good news about my claim the letter also went into details of how they had looked into the unclaimed loan and found the case unproven to no refund would be awarded.

These are my questions to those in the know:

Is this a tactic of the bank to deflect attention away from a second claim?

How can the bank award or not when I have not filled in a questionnaire about how the PPI was sold to me etc.

What to do now.
Go ahead and claim using MSE template and ignore the banks letter when it refers to the second loan.
Call the number provided on the banks letter where It says ‘If you are unhappy with the details etc etc
Take the letter further up to the Ombudsman

Any advice gratefully received.

    I've never heard of this as a "tactic". I did, however, have two loans I had no knowledge of upheld as part of my complaint.
    I think whether you complain about this other loan (again) largely depends on your reasons. If you have valid and verifiable complaint reasons then you should state these in a fresh complaint. If you have no proof of your concerns, then I'd take it as read that the other loan has been dealt with already as part of your original complaint.

    My question to you is why didn't you complain about this loan in the first place? Do you really want to wait months for individual loan complaints to be answered? Do you think that's fair to others who are also waiting for their complaints to be dealt with?
  • Hi. The reason I did this loan first is that it is still running. The reason for dealing with one loan at a time is because that seemed the proper way. I did not want to throw all my complaints into one pot. Details of one claim/meeting/employment status may differ from another. I do intent to claim (for the first time) about this loan as I feel my claim would be valid. To have it rejected by the bank without details from me about what I was asked/informed etc in any meeting would be premature. I would also point out that if we all 'take it as read' everything the banks said none of use would be claiming back our money.

    I agree. But you could still have complained together with your original claim by simply filling in a separate complaint form!

    I see you still haven't detailed exactly what your reasons for complaint are, nor on what basis the Bank have declined to uphold a potential complaint.
    I strongly suspect that if you put a fresh complaint in which duplicates the basis of their rejection then you'll just get a reiteration of what they've written already.

    Again, you need valid and verifiable reasons for complaint. Every complaint is dealt with on it's own merits (or lack of).

How can the bank know what the reason were for any claim I may put in for the first loan before rejecting it. As you put it 'Every complaint is dealt with on it's own merits (or lack of).' They have not asked me the merits before rejecting it.

    So I do not intend to comment further except to say that you are posting under a pseudonym which makes it virtually impossible for you to be identified.
    I sincerely doubt any claim handlers routinely monitor this forum!

    No. It is good service and good practice by the bank to investigate earlier sales following your complaint.

    it has it's own files and if they find a wrong doing in their own files then they dont need you to give them reasons. If they dont find any wrong doing in their own files then they are telling you as such. So, you will know that the same reasons you have given so far wont work with them.

    If you have valid reasons for the mis sell of the second loan then reject the reasons they give for not upholding and ask them to look at this again, if they reject again then send it to FOS.
