Faulty Vehicle Bought on Credit Card

    The credit card amount is only part of the transaction - you still PX a car which, before you return their vehicle, you need returned to you (or the cash equivalent). How you proceed is up to you - what will the car you have cost to repair and make roadworthy. This cost should be deducted from the amount you owe the dealer, with the remainder being paid as the revised sale amount.

    Yep exactly!! You got it. This is what i tried to explain to the credit card company in the letter. And that is EXACTLY what i said to them, let me get the car repaired, send you (credit card company) the bill and you give the dealer the remainder - But they just refunded me the whole amount. I rang them up in fury, their telephone advisors wont put me through to the legal team, i have to "write" to them. All this adds to the delay, i still have no drivable car.

    In terms of repairs - The car costed £2500. repairs without an exhaust will amount upto £1000. Now VOSA inspection only gave advisory on corroded exhaust, but my point is that it wasnt bought to my attention. VOSA will carry out action against garage who did the MOT. Anyway, so if i am having it repaired, i want to fix the exhaust too - this can range from £800 - £1200 alone in addition to £1000 repairs (i.a.w a rough estimate given by a local garage).
    But i dont wanna touch the car until i know what the dealer's counter claim will be.

    Trading standards have just advised me to go ahead and buy a new car, keep this car parked until all this gets resolved, which obviosuly will be months.

    It is not clear, is this what you paid in addition to trade in?

    If the car is as bad as you describe, I don't understand why you would be considering having it repaired?

    I would be seeing a good solicitor soonest. You may have legal cover with your car insurance?

    Sorry, ill try and explain, the PX part is complicated because of the shortcomings in the paperwork the dealer gave me, so-

    • Cost of Mazda i bought - £2500
    • Money dealer deducted for BMW that i px - £750
    • So in total i paid -£1750 & 3% credit card charge = £1802.

    Now, there can be two scenarios when i return the mazda to him -
    a) dealer gives me my BMW back - i dont want that because i am 100% certain he will tamper with it to get back at me. He was already saying over the phone that xyz is wrong with my BMW, hes living with it so i should live with his Mazda too (i know, i know hes an idiot and unprofessional, hence all the mess).

    b) dealer gives me £750 back for my BMW - now this is where it gets complex. He hasnt written anywhere that he gave me £750 for my BMW. hes not even written on the invoice that the mazda was £2500. All he has written is £1750 paid. His internet advert, that i found later had the car on for £2300, but physically he had £2500 on the car and thats what i paid. I fear ill loose this argument with the credit card company that the car was £2500 as i dont have it written down anywhere.

    So for now, credit card company have given me the whole £1802 back. They are now waiting for the dealers response.
