Carers Allowance & Income Support

Hey there

My wife is in receipt of DLA - High Mobility and Middle Care and as such, I receive Carers Allowance.

Recently, the wonderful ATOS found her "fit to work" and her ESA, which she claimed as a couple, stopped and she's been told to go and get a job as a bricklayer or somesuch ..

Would I be able to claim Income Support in addition to my Carers Allowance due to her losing her ESA as regardless of what they say, she certainly isn't "fit for work" and so she wouldn't be able to claim JSA and given that I care for her daily, there's no way I can claim JSA as I can't get a job (thats what my Carers Allowance is for)?

    You can certainly claim Income Support as a carer.

    I would advise appealing ATOS decision, a large proportion of people who to tribunal get the decision overturned and ESA reinstated.

    When was her DLA assessed? Has this been done recently?

    She is appealing the decision, but, they've decided to look at it again first .. which of course, could take them 3 weeks or so and so she won't get the assessment rate of ESA which she can get when waiting appeal (or have I got that wrong??). The decision was the usual farce you get from ATOS .. lies, misrepresention of events and blatent omissions of relevant information ..

    She initially got awarded DLA for 3 years and then it got re-assessed in April where she got it awarded indefinitely .. well, until the next hatchet job with the swap over to PiP ..

    So if I did apply for Income Support .. would that amount be upto the max available (circa £111 a week) as the Carers and Child Tax for our 1 kid is the only income we have?

    You should write a letter to DWP stating she wishes to stay on assessment rate of ESA whilst the appeal is heard. This is not necessary but does not give them any room for manovoure (sp?)

    As for income support entitlement please put your info into https://www.turn2us.org.uk and that will tell you what your entitlement is.

    You could also look at applying for LHA/HB/CTB.

    If she has made a request for reconsideration, they will not pay her.
    Only if she has made an actual appeal, in writing.
    Has this been done?
    Once it has, it should be payable.

    you trally dont support your own cause. no one suggested that she became a brick ayer did they? youre more likely to get a positive response if you cut out the sarcasm ....

    Apologies for lightening the mood of a serious forum post .. but, for your information, when I spoke to the DWP when they phoned to tell her she had failed her medical .. I asked "what? She's fit to work and to go get a job anywhere from an office job to a bricklayer?" .. and guess what? The woman laughed and said .. "Well .. yeah" ..

    So before you start telling me off ................. :cool:

    We sent them a letter last week saying she wants to appeal and pointing out the areas where there are .. inconsistencies .. between what was said during the ATOS assessment and what had been reported .. ie, why she's disputing the decision.

    She never asked them to reconsider it. They've just sent a letter saying they are going to.

    However, given that half that time through the explanation of the decision they were calling her a completely different name (which we pointed out) - maybe they felt they had to to cover their own backsides.
