Thanks for all the advice. I will post back if they attempt anything about the change in the law.
Hi Coupon-mad they date they sent the letter out is the 3/10 but the parking "ticket" is for the 28/9, we are in Scotland and unfortunately the POPLA appeals service wouldnt have been an option for us as it appears only to cover England and Wales at this time. (if I've read the info correctly).
Really appreciate the advice and feel reassured after reading the replies.
Yes you are right - it doesn't apply in Scotland and I should have asked you.
But the only bad news about that is that you can't have some fun and cost the PPC £32+ over your fake ticket.
The good news is that they cannot pretend that the registered keeper is liable either and if you get any letters which suggest the registered keeper or owner is responsible then send a copy of the letter to the DVLA as a complaint. Head the subject line with something like 'URGENT complaint about AOS member claiming registered keeper liability in Scotland (private parking)' and send to FOI@dvla.gsi.gov.uk
The other good news, if you are so minded, is that you could sue them for damages in Small Claims and make a few hundred pounds in compensation for this disability act breach. Did you have a Blue Badge displayed? And yet they relied upon ANPR to time your stay (with no thought given to allowing disabled people longer?).
So read this, but where it says DDA read 'Equality Act 2010' which it is now:
http://news.bbc.co.uk/1/hi/uk/8488737.stm
If you are up for the fight back then send a copy of that (or a link on a complaint email) to the main retail/business occupant of the car park and a copy to ECP as well, telling them they've broken the Equality Act 2010 and what are they going to do about it before you sue them for damages? Or words to that effect along with some proof of your disability.
If you want to ignore it all that's OK but just thought you'd like to know about the fighting back options, particularly when the debt collector letters get irksome and harassing. You do not have to put up with this at all.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's nice to know. Not the impression they give their targets is it? All these halfheads seem to send threatograms from solicitors or from members of their litigation teams, people working in so-called offices such as "legal department".
When back in early 2011 I took these theats more seriously but still refused to pay, I would initially write to the antagonists. I got one from a "solicitor" and I shalln't forget my last line:
"This is my final word on the affair, if you are not satisfied with this decision then I suggest you take the matter to adjudication, otherwise please seek legal advice."
Then, ME telling a solicitor to "seek legal advice"! Wasn't far wrong though was I? He doesn't write any more and they never got a penny from me.
...can you honestly imagine one lawyer phoning up another and saying, "er, I'm a lawyer, but I don't know the law on what I claim to know...can you help?"

Hi all
Recieved a Parking Charge Notice from Euro Car Parks today wanting £100 and if paid within 14 days it will reduce to £60. They have recorded my reg number on the notice as well. Twice! I did pay for car parking on this private parking site, but went over by an hour or two. It was in the centre of Birmingham at the back of the Chung Yung Garden chinese restaurant. What do I do? Pay or ignore?
Cheers and thanks.0 -
