I have LPA for my mother- in- law. I have used this in recent times to start managing her financial affairs. [She as mild dementia]. I have been successful with every organisation and used to sell her old home without problem. However, one financial organisation HQ in Bristol is refusing to recognise the LPA. Stating that my M-i-L holds the investment in a Trustee capacity. The Trustee Delegation Act 1999 and S25[5] of the Trustee Act 1925 have been quoted as reasons why it is not valid. They advise I will have to apply to the Court of Protection to access/manage investment. Any help or advice would be welcome
