Housing benefit completely stopped!

So I signed off on Monday 1st October, then Tuesday 2nd October my mum got a letter from housing benefit saying the wer cancelling payments because I'm back in work! How ridiculous! I am fuming! I 23 and still living at home with my son and mum! We're private renting and the rent is 1100 pm. I've gone self employed with a brand new business and there's no way I will even earn enough to cover this! Probably won't even earn enough to cover the council tax bill! When I asked how long it would take to process, he replied how longs a piece of string! I said I may as well sign back on then, to he replied that hb would be sorted out quicker if I signed back on! The people at the job centre and working tax were brilliant to deal with, really helpful but hb are a nightmare! Has anyone had their hb cancelled or know how long roughly it could take to process? I don't want to sign back on, I want to build my business to eventually support myself and my son all by myself! My mums a carer for my disabled sister by the way.

I didn't think you could get hb when living with parents is the tenancy in your name or your mums.
You don't need to sign back on you just need to do a claim for hb and as your earning nothing you will get it.

Can you clarify whether it's you or your mother who's claiming HB?

It's my mum who's on the tenancy and claims hb! I had to give them my estimated income for 6 months

She should still get HB then, they would deduct an amount for a non dependent adult from her benefit according to your wage. So they would/should ask for evidence of your income and then work out what to deduct.

Thanks for your replies! I know it's a long shot and your probably don't know, but any idea how long it will take to process? Rents due next week. I have asked hb but I may as well just talk to a brick wall!
  • Mine took about 10 days to sort out when I went self employed. You have to give them estimated earnings at first then every 3 months take your accounts and receipts in, then they back date any adjustments.

Contact your landlord and explain the situation. He will get his money but he might have to wait for it.

My understanding (feel free to correct me) is that local councils are often frustrated by claimants not providing information about their non-dependent's income so they can arrange the appropriate deductions from CT and HB, so they either cancel the claim or deduct the maximum non-dependent deductions until such time the claimant sorts out their new claims with them.

Cancelling the whole HB claim sounds a terrible and clumsy way of dealing with the failure of a claimant to come forward on a timely basis with a change of circumstance that is only likely to be a modest reduction in their claim.

I believe that a claimant can ask for an interim housing benefit payment if after 2 weeks, a local council has received the full application and all relevant information, and they have not yet processed the claim.

Thing is, hb were the first people I contacted last Monday and they sent me out a form to fill in which I got last Friday. They also took estimated earnings off me over the phone! It's just a shock they barely gave me 24hrs after signing off before they cancelled my mums claim! Its not like i suddenly signed off and they had no idea, i called themthe week before i planned to sign off! I had the form filled out ready to send back on Tuesday but luckily we got the letter before I posted it so I went straight down there to hand it to them personally! Just hope it gets sorted quickly, I hate that it's my fault my mum is in this position!
