I was advised to claim ESA, but I still have a job. My half pay stops this month, and does anyone know what I can claim if they find me fit for work, but my gp and my Occupational Health says I am not fit for the job.
Also when can I claim mortgage help? I am on contribution based ESA assessment period, been for the medical already, but no that they will say I am fit.....

Occupational Health says I am not fit for the job.
But didn't you previously report that you had been offered a new job within the organisation and were returning to work?0 -

Quoted, just in case.Science adjusts its views based on what's observed.
Faith is the denial of observation, so that belief can be preserved.

First thing first call DWP and request a copy of the ESA85 ATOS medical report... that'll give you strong indication as to what decision the DWP will likely take... i nfact they may as good as simply rubber stamp the findings in a few weeks' time."Do not attribute to conspiracy what can adequately be explained by incompetence" - rogerblack0

Yes they have a job for me, but at the moment I need time to recover. Insurance does not cover you in work, if you cannot get a fit to work notice from your GP and OHS.0 -

Yes I think you can claim ESA while employed and off sick.
SSP is payable for the first 6months, this used to then stop and you had to claim incapacity benefit, which has now been migrated to ESA.
If you are refused ESA on the grounds that you are fit enough to work, I would be asking your employer to pay it or find you suitable alternative work.
Unfortunatley the system does not seem to be able to cope with those claiming benefits while employed but not getting paid.0 -
if the result of your wca is that they find you have no lcw (limited capability for work) you can appeal. you can pick up a GL24 from your local jobcenter or there is a link in the useful links page that you can print out. Get your gp to write you a letter stating that he also thinks that you have LCW. appeals take around 6 months (sometimes longer) and you will be paid at the assesment rate of esa which is £71 pw. please remember you will have to provide med certs for the period you are on appeal starting from the date you are found to have no lcw.
you can claim esa if your ssp has stopped you may have to get a sp1 form from your employer which basically states the reasons they cannot pay you ssp anymore and send that into the esa.
you can claim for help with help for your mortguage interest pymts after claiming esa for 13 weeks.0
