Currently off sick but company wants to make me redundant

Hi
Currently i am on sick. I have been off for 6 weeks (i had a mini-stroke). Do not know when i will be fit for work, hopefully soon.
Just had a phone call from work asking me to come in to talk about redundancy. They say work has dropped off a lot and i have found out that they have made some people redundant today.
What are my rights?
Can they make me redundant while i am on sick?
Do they have to wait until i am back to work?
If they can make me redundant i guess they should pay me notice at full pay?
I work at an engineering company and have been there 2.25 years.

thanks

yes they can - redundancy is based on work diminishing/changing not personal.

No they don't have to wait until you are back at work. But if they are doing a "selection process" - then they need to consider your absence. Eg in my business they do this via online emailed submissions - not face to face interviews.

Yes they need to pay you your notice pay as per contract and 2 years redundancy pay (based on under 40 years old) - more if older. they can cap the redundancy at £430 a week.
  • If the meeting is going to be detrimental to your health you can delay it and you will require a fit note to cover that.

You should be invited to consultation meetings but if you don't feel up to it I would suggest doing it via conference call but don't miss these meetings and if you aren't we'll delay them.

If you are made redundant the will be required to pay you noticed, if you are still off sick providing you provide a fit note for that period (to cover the notice period) then they still need to pay you as normal as if you we're a work.
