Redundancy - Treatment of Company Benefits and Claiming Benefits

Well looks like I'm out of work in the very near future.

Expecting to be made a settlement offer tomorrow. Have been in employment 3 full years and notice period of 4 weeks.

I expect to be handing my company car back when I finish, rather than hanging on to it through notice period. How much should I be looking for in my settlement owing to my car/fuel?

Cash value of car: 4500
Cash value of fuel: 4200

I'm a 20% tax payer.

Anyone able to give me a steer?

Also, if i register for job seekers allowance, is there anywhere I can find or calculate any indication of how much I may receive?

  • As it's a benefit you're entitled to until the end of employment, why not have use of it throughout the notice period?

    In any case, if you do hand it back early, do you then have a right to any alternate form of compensation in it's place? I'd think not, unless your contract states otherwise.

    So I'd think that that the company would see this as a decision by you not to take part of the benefits package you're entitled to, so why do they have any obligations?
  • Perhaps I could have worded my original post better.

    Rather than me 'handing' it back I expect them to ask for it back. However they may not. I assume I have no choice to make, ie cash or car (in view of the car + fuel benefits).

    For my 3 weeks statutory, am I entitled to the car and fuels benefit? Does it just go on top of my salary for the purpose of their calculations?

    You need to be clearer why you are leaving and what is happening about notice.

    What is the contractual and statutory notice. and if redundant the service calculation for that could be different to the notice.

    Any enhanced severence payment can include just about anything they want so it could be down to negotiation on the cash value for the benifits if you are getting PILON.
