Income support + Caring for someone issue.

Well i need some good advice.

The person i was caring for was refused a renewal of DLA which in my opinion is crazy because the person im caring really does need it.

My problem is my carers allowance ended about 27th of august, so now income support have allowed me to have this allowance untill october 25th.

My problem is im not going to be in a position to look for work as i still need to look after the person im caring for and i dont think JSA and caring would be time permitting. There is currently an appeal in for the DLA so im not sure whats to happen right now.

What should I do?

there is nothing you can do.
you either claim JSA and actively seek employment or you will not receive benefit

You may still be able to claim Income Support for providing the care even though CA is no longer payable, however, you'll need to get advice how to proceed with this. See your local CAB or Welfare Rights.

I know someone who was in the exact same position and they had to claim JSA and seek work (and continue to care) and then 5 months later the DLA Tribunal was successful so they re-applied for IS and CA but although the person with DLA got the back pay the carer didn't for the 5 months.

I am unsure, but suspect it may have been possible to get the carers premium backdated for the period of JSA.

You need to seek the help of a welfare rights adviser from the CAB or Legal Help centre who can appeal the DLA claim and see if it can be reinstated.

IS are quite right they cannot do anything if the DLA claim has been turned down, but if you can get the DLA claim backdated then carers can be backdated too.
