    Put a gate in.
    If it's a new build, was it something like a field before?
    Usually you find no one really wants to be bothered cutting a small border, unless it's by one of the new houses.
    So you may find they'll be happy to let you adopt it.
    Unless you finish up driving past their lounge window every day.

    you really need to speak to the house builder
    they have already told you what the situation is so maybe you could ask about buying it
    the problem is if you just try to adopt it and its not in their interest or by allowing yourself access you some how in their eyes devalue their build or design they may try to chase money off you

    I have tried but the only way I can get access to them would be through the sales person who was very unhelpful. She was very nice when she thought she was going to sell us a house but change a lot since we bought this one... Every time we ask her something she responds as if she's the owner of the building company. She even said something in the lines of "We don't go around building random driveways!". I haven't even asked them to. Oh well...

    thats just a sales office you would have to speak to the main building firm involved or whoever is in charge of the whole project
