Naming the Driver....... Lucrative ?

Being a busy man, running my own businesses and being the Registered Keeper for a fleet of vehicles I anticipate quite a few letters from PPCs asking me to tell them who was driving when one of their scam tickets/ANPR tickets was issued.

Obviously I don't want this extra task to impact on my main role but it would seem that I have no option if I want to avoid being pursued by the PPC as the RK instead of the driver.

To fully investigate who was driving and verifying I have the correct information could take up a significant amount of my time. In fact more time than I am willing to give away for free to another business who intend to use the information I provide to generate their income.

As such I will write back offering to carry out the work after they have paid for my time. My standard rate when offering my time as a consultant is £55.00 +VAT per hour with a minimum charge of one hour when the work can be done without leaving my office.

I will make it plain that I am not refusing to name the driver but need to be compensated for my pre-estimate of loss while carrying out the work they have asked me to do.

If they refuse to engage me on the above terms then I will either just continue down the ignore route I have trodden so many times in the past, or take up a little of my time and pee £27+VAT of their money down the drain in a fruitless (for them) appeal procedure, and then ignore them.

    You may wish to state that should a county court claim be made against you, as the Registered Keeper, you will counterclaim for your amount.

    The RK is only 'invited' to provide information, so I can see that to do so would incur costs.

    Would be nice, but they have a habit of passing that cost onto the driver rather than the PPC.

    That was my approach before I ignored them, I also had a fleet so got them on a regular basis. I simply wrote back saying as there was no statutory right to the information they wanted, they could have it on a commercial basis. I used to ask them for the same as they claimed!

    Only one ever got back saying they would pay after they got the info! :p Yea OK, ignored them and never heard from them again.

    Pity I only have a few registered to me now, I haven't had an invoice for ages!

    Nothing to do with the invoices and begging letters. But..
    If you run a fleet you should already know who was driving that vehicle at that time though.

    I like the idea of sending them a bill for supplying the requested, Data.
    The DVLA do it. £55+vat maybe a bit steep though.

    £12.50 sounds like a nice number. Or offer them a years membership for £55+vat?

    Steep? That's cheap in my industry. I could easily demonstrate a loss of £55 +VAT if I had to stop working on a client's job to deal with a PPC request.

    I could perhaps offer them a 5% discount if they wanted to prepay for a batch of 10 hours.;)

    If you had a ticket before oct 1st and were not the driver is there any way you could be forced to give the details of the driver??

    No. What's more, if you get a ticket after October 1st, they can't force you to name the driver. I guess the BPA would've liked the power to apply thumbscrews or throw you in the Tower of London, but they didn't get it.

    I could pull specific drivers details in seconds, but then I would have to see if the vehicle was in the area claimed!

    £55 is not steep they would be paying for what you know, not for what you do!;)
