Paypal dispute refund question

Can a seller refund my payment during a dispute (non delivery). I have not yet escalated the claim.
The sellers response was "The case needs to be closed before it will allow me to issue a refund"
Is this true?

    The whole point of opening the dispute so you can communicate and resolve the issue. Once they refund the case closes automatically, if on the other had they do not communicate and nothing changes you can escalate, PayPal give them a set time to respond and if it is not resolved - prove tracking /delivery of goods or refund then PP refund you (I had to do a dispute and the seller was unhappy as it froze her PayPal account until she refunded even though I had not escalated, she very quickly refunded when she could not use her account!).

    Do not close until you have resolved the issue, if they do not refund you can not re open the case.

    Looks like it, definitely do not close until you have the goods or refund.
    (By the way did you raise a dispute via eBay or PayPal - assuming this is an eBay purchase. As I always find it more efficient and a smoother process to do the dispute by going directly to PayPal, it certainly seems more straightforward than eBay, others that open in eBay seem to have as less smooth process).
