Yes all paid up after the Judgement, no need for the "Sheriffs to Come" (love that BBC3 show when people who don't want to pay their debts get in an uncomfortable position!)
The defence essentially was that they believed as the bike was "used" they could refuse a refund outright. Not only did I dispute this but this is not the procedure with DSR's.
Most of the effort in the 5 page or so defence was trying to discredit my character and portray me as a liar, which probably did more harm than good to their defence.
They missed the point completely really, still amazed at how they fought this to the end despite what was a cast iron case really. I couldn't have spelled it out any clearer to them.
I will be going back to the "independant" review website to make them aware of what has happened in my case, and make them aware I wasn't happy about how negative reviews were removed and question their cosy relationship with retailers. Not that they will give a damn, but hey who know maybe some feedback will help in some small way...0 -
But did they turn up at Court?
Well done by the way.0 -
Congratulations, and well done for sticking at it!
Just out of interest, what's the review site?0 -
It, only took 5 minutes in court so they couldn't have fought it in court, so it would have been a default judgement.0

Yes. Not exactly a default judgment as in theory the judge would have looked at the Defence.
However, I have not known a small claim to be won by a party not in attendance and only fires off a defence and 'can't be bothered' to attend. To be honest it gets Judges backs up as they ought to have settled and vacated the hearing date.0
