    Get them to confirm that they won't alter your ncd even temporarily as this won't be concluded in time for your renewal if you are wanting to move insurer at renewal time.

    I have photos and a witness so I don't see how he can dispute liability but you never know.

    May I suggest that you press your insurer to get the witness statement ASAP (if they haven't already).

    Our insurer took 10 months to contact our witness, during which time she got a couple of details wrong, so our insurer said no court would accept the statement as valid and so refused to fight the claim from the 3rd party and settled 50/50 against our wishes. Nothing we could do about it apparently.
