Hello,
I got delayed by thomas cook this summer for 4 hours (meaning they owe me 400 euros due to EU law.. learnt from this site) however they quoted they were waiting the outcome of an appeal which was suppose to happen 19th september
does anyone know the outcome? i have seen no stories in the press

Thanks for the reply!
Funny they have AGAIN changed the court date. i had it in writing from thomas cook that it was 19th sept lol no wonder i couldnt find any news.
my route was from lazarote to gatwick.. 4 hours due to a defective plane
i checked and plane defects do not count as exceptional circumstances so they owe me an ammount.. not sure how much as i dunno if its for just me or for me and my friend could be 400 between or 400 each0 -
400€ each but you are going to have to 'work' to get it!0

Brilliant! Believe me soon as the court ruling favors us the customer I will be on them. This year sky, bt, Vodafone and e learning have all paid out to me with my persistence with their poor service. I won't let Thomas cook get away with it0 -
Result was 3-2 in extra time so out of 'Europe' next year.0

So just because your flight left 4 hours late you want compo?
Tell you what, next time tell them to he'll with the fault, you want that plane to fly or you are gonna demand compensation
This is the sort of thing that will be the end of cheap travel. I dread this ruling coming out, ill thought out legislation. I might even be on O'learys side for this one.The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.0 -

It'll still be very difficult to get! They won't just give compensation out if you ask nicely.
The regulation has been around for over 7 years, is travel still cheap?
It'll have no travel price implications whatsoever.
Captains aren't influenced at all by this regulation.Posts are not advice and must not be relied upon.0 -

Had the 'plane been properly maintained, it would probably not have developed the fault. And the law makes it clear that if something that genuinely could not have been prevented causes a delay, then no compensation is to be paid.
We all want cheap travel, but not at the cost of carriers saving money on maintenance and other aspects of safety. This legislation will actually put them under pressure to raise standards.0 -
