Halifax PPI rejection and appeal length of time

i put in a claim for miss-selling PPI with Halifax on about the 27th June and received a letter of rejection on the 17th July, i then rang them up to appeal on the 24th July and they have still yet to resolve this appeal which is now over 8 weeks. i rang them up 2 days ago to enquire what was happening and i informed them that it is over 8 weeks and it should of been resolved by now, the advisor told me that a claim for PPI must be resolved within 8 weeks but because i am appealing against a rejection that the FSO have not set a time limit for rejections to be dealt with and the 8 week time limit only applys to new claims and not appeals. if i would of known this i would of just appealed to the FSO instead, is this correct? thanks

    I'm not really sure what you mean. But this is how it works.
    You complain to firm.
    They have up to 8 weeks to investigate.
    They issue a final response. There is no appeal process (unless they didnt issue a final response and its actually a first response.)
    You either agree or refer to complaint to FOS within 6 months.
  • the letter does not state that it is a final response it just says.

    if you do not agree with this decision please contact us or write in providing further supporting evidence to support you claim. i will consider any additional information and advise you whether it changes my decision. if i do not hear from you within 28 days from the date of this letter i will close your complaint and consider it resolved
    in the event that you remain unhappy with my decision you have the right to refer your complaint to the FSO any referal to the FSO must be made within six months of the date of this letter.

    i assume that this must be the final respons letter, i rang up adding more information and am awaiting the outcome. they have already rejected two dseperate loan PPI claims and paid out on another one which stated in the letter that this was a final response with a cheque.
    i will probably just ring them up tomorrow and inform them that i am just taking it to the FSO, thanks for replying

    Unless you have SIGNIFICANT NEW EVIDENCE OR INFORMATION, it's a waste of time getting into a "war of words" with the Bank. If you simply disagree with the Bank's rejection, refer it to FOS.

    The letter is a final letter unless you have significant new evidence or information. As you dont then you take it to the FOS if you dont agree with their decision.

    Just get your evidence ready for the FOS and sit back and wait.

  • I deal with PPI complaints for Halifax. If you make a new complaint point, which is different to your original complaint then they will re-consider your case. The fact that it is taking so long for them to come back to you shows that they have sent it for re-review, otherwise you would have received a letter before now.
    Even if it is after 28 days since you received your response they will still re-open your case if you are unhappy with the decision.
