Whether it's difficult really depends on what's involved. Even when estates are not simple you can get help with filling in the paperwork from the helpline 0845 30 20 900 and just pay a solicitor for the legal advice you need rather than hand over the whole job. e.g. we did mum's estate but paid the solicitor to set up the trust stipulated in her Will. Quite often the most difficult part is locating the information on what bank accounts they had and whether there was a funeral plan etc - a job you'd have to do for the solicitor anyway.
The Which? Wills and Probate book is far cheaper than a solicitor and takes you through it step by step. You may be able to borrow it from your local library or buy it cheaper somewhere else but check it's the up to date edition.Eat food. Not too much. Mostly plants - Michael Pollan

I managed to do it and I was very under-confident. I recommed Probate made Simple - Getting the most out of your solicitor. Andrew Komarnyckyj
The book states where you should consider having a solicitor. What I found very useful is the were template letters, which could be adapted. These templates made my life so much easier.
If you think it's a fairly simple estate the go for it and do it yourself.0 -
I've just done it for my dad's estate, have got appointment with Probate office on Thursday to swear the oath. I was a little bit daunted at first, but fortunately it was a very simple estate and my mum had all the necessary paperwork to hand which made the job a lot easier. i had a couple of queries which the help line were able to clear up for me.0

it depends on whether you actually need probate or not, my mum died 8 weeks ago, very simple estate no probate needed, but I was going to do it myself if it was needed, lots of info on the net0

Everything you should really need to know regarding changing the land register is contained in our FAQs and Public Guide 9 on our website
If the property is registered and you intend to keep it then you should just need to complete forms AP1 (application form) and AS1 (an Assent) by the executor(s) to the beneficiary.
However it is important to match the circumstances to the right FAQ/scenario as each circumstance can be slightly different.
If any further questions arise re the guidance provide or as to the actual form filling then simply contact our Customer Support Centre - please note that we cannot provide legal advice though“Official Company Representative

I have just contacted a Probate & Will writing company as my Father died at Christmas (in testate). I have been told they can handle Letters of Administration for me, write a will for my Mother AND can make my Mother & I Tennants in Common & thus protect any possibility of a forced sale of the only asset, the house in the event of my Mother needing a Care home (currently she has A Carer partly paid by local authority & she also contributes. This sounds potentially a huge weight off my mind. Am I being nieve. My questions are 1. Is this possible? 2. The company are not Solicitors so what should I be looking for in the way of qualifications etc???0

Joey, it's probably a good idea if you start a new thread for this. Click HERE and you'll find a blue 'New Thread' button on the right hand side above the list of threads.
