Help! DFS refusing to cancel order after they have denied credit agreement!

    The second word of my response to them would be "off". ;)
    I would have a chat with your local trading standards, you never know they may have had a few complaints. This type of behaviour is worthy of an OFT investigation into their practices. I used to work in retail and we would never put through the order until the finance was accepted, the finance (with GE Capital, now Santander) was done on line with instant response.
  • Just to say thanks for your advice everyone, it's all been resolved now.

    After coming back from work, we've found an answer phone message from the sales agent who very politely explained that because the sofa is so popular they will be able to sell it very easily when it arrives in store.

    They wished us the best of luck with our future purchases, and said they would welcome our custom again. So long as we have appropriate credit.
  • Hi I know im bringing This back up, but we have had this sort of happen to my partner & i in the last two days. We went in on sunday, the 10th of feb. said we wanted a sofa & Chair, We must of got the finance as the lady had this little computer thing with her, we had to listen to this thing go on about are t&c,s Now I paid a £200 deposit as we don't like to have alot of credit hanging over us.
    But when we got home we could not fit the chair where we wanted and said we would see if we could change the chair for a foot stall. When my partner phoned them they said, yep no problem we can do that. So i took the afternoon of work to go back to confirm that she had changed it over, and then she said im sorry you have got Declined !!!! WHAT ??? That cant be right can it??

    We got the signed contract saying it would be 13 weeks for delivery .
    But now the bad thing. The lady in the store said she had tried to get the Finance with another company that also got turned down wile we was in store, Then she said she would try another one and that she would ring us today with the outcome.

    Now i have just taken another half day to go back up there to sort this crap out. As i don't understand what they have done.

    So did we get the Finance or not ?? If they took are money ??
    And can i get this back ?? As to me they are the ones who Canceled it not us ???

    We are going back up there in an hour to see what we can sort out about this mess , But it now looks like they have messed up my Partners chance of getting credit for a wile as they must of put it though 3 times now. :( And she is gutted.

    Yes they also said about have we got a family or friend who could lend us the money .. lol

    As stated earlier in the thread, the contract with DFS to purchase for which you made part payment of £200 is separate from the application for credit for a completely different company. The contract to purchase has not been cancelled, if you read the thread this is all explained.

    TBH I don't see that they have messed up your partner's credit since she was being declined anyway, but you might complain if they ran additional unauthorised credit searches.

    Sorry but this and any other responses on this thread that give that explanation are incorrect.

    If you go into a store and that store arranges a regulated credit agreement as well as selling a item then the sale person is acting as a agent for the credit company as well as the store.

    In other words the transaction is linked and if the credit agreement is not executed then the prospective purchaser has the right to cancel.

    Tis all in the Consumer Credit Act in this case Section 57

    It's quite simple. Have the shop been paid?

    The answer is no. Therefore there is no contract. Simple as that. Tell them to do one.

    EDIT: To make it simpler. If I go to a shop and ask to buy some goods, and hand over my card which is then declined, am I obliged to find another source of payment or can I just say "Sorry, I don't have enough" and leave.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
