Deposit not returned within 10 days & incorrect

Hi everyone

Just looking for a bit of advice, My friend and I moved out of our flat at the start of September (contract ended 3rd September) and as I understand it the deposit had to be paid back within 10 days. After 10 days we still had not received it.

After numerous emails and giving them our forwarding address twice (bearing in mind we gave it to them anyway when we moved) we received it yesterday (postmarked 27th September). To add insult to injury the letter states it was left in clean condition etc and no deductions have been made but they have still managed to refund us £210 short so this now means more chasing!

I'm just really annoyed that they can do this as we need that money! :( We are lucky we had savings to pay the deposit for current place but what if we had to take out a payday loan for 2 weeks thinking we would get it back with the legal limit and ended up enduring charges?!

Surely if a legal precedent has been set they cannot do this?

Any advice from those in the know would be much appreciated :)

  • Seems that despite the 10 days rule landlords can take as long as they like. It's taken me 20 days to receive a cheque despite asking for the money to be paid into my bank account. Add on the time it takes to clear and it's taken over 3 weeks to return my own money to me
