Car insurance accident - not at fault - write off help

Hi everyone,

3 weeks ago my car (09 Toyota yaris) was driven into the back off by a third party who has come out and accepted full responsibility, roll on 2 weeks later and my insurance company(endsleigh) have deemed my car a write off which I thought would happen. Since then I've been out and bought myself a new car before any settlement has been made and endsleigh want to chuck another £100 a month onto my premiums but I have found another company that will do it for about what I pay now.

My question is after my claim has been settled for the value of my car, can my insurance with endsleigh be stopped without any further payments by myself as I was not my fault?

I've searched everywhere for an answer but couldn't find one and worried am gonna be left out of pocket for a crash that wasn't my fault.

    Your problem looks to be making a claim off your own insurer. Because of this they may insist on you paying the policy in full pending them getting full reimbursement from the third party.

    Contact them and ask them what it will cost to cancel your policy, and take it from their reply.

    Well you can't insure a car that does not exist anymore....

    I take it that you did declare the current claim to the new company that quoted you.

    Car insurance is for a year even when paid by instalments so when there's a claim then yes you do need to pay for the outstanding payments. If you insure a new care then that may not happen

    If they dont cancel the policy because its a total write off claim, Not all do.

    Then the best option would be swap your new car to this policy until it expires.

    Are your insurers claiming its a fault or non fault claim? How did you declare it when getting quotes?

    If your insurance have paid out and not been paid back yet then they may say its a fault claim until settled.

  • I just cant understand why i would have to pay out my policy when am not at fault, if it was my fault i could understand, wasnt my choice to be crashed into and have my car written off so would have to look at canceling it!

    They are telling me i am claiming on my policy until they recover the costs from the third party, does that mean technically my 2 years no claims is invalid? I understand that means my policy is still valid till it is settled but wht about when it has been settled?

    If they get full reimbursement of all their costs then your ncd will be reinstated.

    So if you want to insure with a new company now, them explain your circs and get3t them to agree that if your ncd is restored they will amend your premium and refund any overcoament.
  • The premium you pay is the risk for the year, if you have an accident (at fault or not) you still have to pay this.

    Different insurers take different approaches to these sorts of things which is why you need to speak to Endsleigh.

    Some will suspend the policy whilst there is no vehicle on cover and thus stop payments. If they recover their outlay in full you can then cancel the policy (normal cancellation fees apply).

    Some will cancel the policy automatically and the balance of the premium is due as you bought a years cover

    Whilst the claim is open the NCD isnt valid unless your insurers say otherwise (most dont these days). You will therefore have to buy with 0 NCD and advise the new insurers that you will have 2 years reinstated once the claim is resolved - you will need to ensure they will be willing to add the NCD mid term as not all insurers will
