Can LHA be claimed?

    the rent would be going rate for 3 bed. shortfall of rent would be payed from his own savings from sale which would cover several years rent before he had to worry abot top ups. this would also take care quite quickly of anything over £16000. he could be forced to sell for commercial reasons by other 2 owners then pay commercial rent at full rate.

    It would take care of anything over £6000. The extra £10000 would reduce any LHA or JSA (if income based) by £40 per week in addition to being used to pay the extra rent until his capital falls below £6000.

    No it's not fine. If circumstances are changed in order to put him in a position to claim LHA that is contrivance and means LHA will not be paid.

    But it wouldn't make him eligible as you have still not explained why he would have to pay rent or why you would force him to sell!

    He doe's not need the rent only the money.

    well yes, i know theres a sliding scale down to 6000 but that will make the capital reduce quicker and theres still £40 lha which would increase as the capital goes down.

    its sthe second brother who would be claimant of lha and he will have entered an arrangement forced on him by the other 2 owners. he would then be in a position where he cant pay rent without lha and not be able to avoid the situation due to his commercial partners out ruling him. how can he have contrived something beyond his control.

    Because no matter how you sugar coat it, there is no need to force him to sell, just so he can claim LHA. It does not make any sense financially other than for pure greed.

    its a shared investment property. just happens that 2 of the investors live there at the moment. if 2 out vote the 1 to sell or buy him out for commercial reasons the single investor has no choice. once hes bought out he needs to pay rent at the going rate or be homeless. then what he needs is determined by lha rates and savings.

    if a business decides to buy a partner out that is up to the owners to decide. if that changes the private circumstances of one of the ex partners thats for them to sort. if that means they need welfare help to meet a liability the cant avoid thats nothing to do with greed its the result of a business decision.

    Just because two of you want to sell you cannot force a sale without going to court, this would cost a lot of money and I'd love to see the reason you'd make up.
