Can you send SAR requests to any company i.e. Clalim Management companies?

Hi and thank you in advance for any help.

I used Consumernet in 2010 to log several PPI and credit card charges when i wasn't very knowledgable in the claiming process.

I was successful with one claim but one is still onging with the FOS after lack of communication from Consumernet. I'm currently in the processes of cancelling this contract with them for being unreliable.

My problem is that I haven't got all of the correspondence from them as I thought all of the claims were unsuccessfull. Now that i am more knowledgable it has come to light that i may have a claim.

I have since sent a SAR to MBNA and recieved details of my account going back to 2001 which shows about £600 of charges. These are all older than six years and i am now aware that you cant claim older than that. I never recieved any details from Consumernet about a possible claim from them with the exception of a letter from consumernets' solicitors who were dealing with the claim for the credit card charges but i have just noticed that it shows the incorrect card number on the letter.

What i need to know is that can i send a SAR to consumernet to find out what documents i sent them incase i provided incorrect account numbers.

I would have thought in their investigations that they would have queried card numbers with me at an early stage.

If i did provide correct or incorrect numbers to them could i try to take them to a small claims court for their incompetent service as they could have made a claim in 2010 which would have got some of my charges back?

    They can only tell you what they hold on your file - the documents you sent may not form part of this uless they were scanned or retained, if they do, you'll get them - but there is no guarantee.

    It always makes sense to keep your OWN copies, rather than rely on a third party who may not take professional care of your documentation.

    My copies were accidentally lost when moving house.

    So does this mean that i can send a SAR to them? I would assume that they have all documents still under the Data Protection Act.

    If you provided them with incorrect information then that would be all they had to work with. Your financial details are not in the public domain and there is no way for them to check the information you provided.
    Regardless, even if this had been the case, sending a complaint to the Bank with the wrong account numbers would have made little difference as the lender would have quickly spotted the error when inputing the number returned no data. It's just as likely the wrong account number was simply mistyped in the solicitor's recent letter to you.

    You can send a SAR letter to them, but if they've destroyed the documents you're only likely to get back the personal details you sent.

    Claims Management Companies don't conduct "investigations". You pay them to represent you in your complaints, which to all intents and purposes mean they put a stamp on the envelope containing your complaint.
