JSA for partner while I am a student

    Well I am sure she wrote down the correct numbers on the application form. They have copied of my student loan, grant and bursary payments and my bank balance. So even if (which i can't see happening, as she knows how much money I have and get from student finance etc) they would have the photocopies of my student loan monies to be paid. They could easy check this. I assume this was the point of providing all the evidence!

    you have been given all the correct information.

    when they realise the error ( and they will) you will at a minimum, be asked to repay the JSA ( and as she hasnt made NI contributions,she wont be entitled to any JSA, as your income is high enough to support both og you ....over £111 a week) or you could find yourselves being investegated for benefit fraud.

    as i said ...
    we have given you the correcct information and what you cjoose to do with it is up to you

    I can see that you gave her the information but do you know definitely that she handed the information in?

    Yes I agree. As I said she will ask them tomorrow, and see what the deal is! Is it benefit fraud if we give the correct information and they make the !!!! up? Even if the monies are paid back on request?

    Fraud would be intentional claiming money through deception not JSA people making a mistake resulting in an error.

    She will ask them. Shall let everyone know the answer!

    Yes positive, she is NOT trying to do benefit fraud. We are both confused. She does not want money from fraud. Crazy.

    So it is fraud for her to accept the money if they make a mistake? As far as i know if she were to keep the money and not say anything and they found the mistake. As she did not make any error all they would do is dock 5 quid a week from the benefit payment due to the benefit repayment, no criminal action.

    Furthermore, it is their job to tell us how much benefit we can receive not for us to tell them how much we should receive. We do not know, that is why we give them the evidence and they assess the claim. Say I did not make this post, I would not be aware of any error.

    No, its not fraud in it's true sense- don't worry about that. But you do need to tell them about the error- it's not the end of the world and you may still get some JSA and likely a good whack of HB even when your income is properly assessed.

    They take your loan and any maintenance grant into account - they divide the years amount by 43 take £10 off and the count it as weekly income to reduce JSA £ for £. If you lose all JSA because of this then HB do the same but only after ignoring £111 each week . Overall a rough estimate is reduced jsa but full housing benefit up to the max payable in your area.
