Road accident - council fault

Your new insurers can also add it as a TAV and you'd include their fees in your uninsured losses claim against the other party if you are successful
i asked my new insurer if they would provide a cover note. they said no0 -

I can see quite a few parallels between your accident and those of motorcyclist having accidents due to diesels spills on the road (little patches of diesel in the wet are deadly for bikes).
Perhaps you could do a search and find out how insurance companies treat claims in those incidents?
Unfortunately, I'm pretty certain that most insurers take the stance of it not being unreasonable to assume that a road may be less than satisfactory due to things such as diesel/oil spills. Complete gray area though so worth pursuing through your insurers.
thanks
my claim handlers seem to be quite supportive at the moment in pursuing the council. i'm not sure if its because they know there is a police report on the fluid leak0 -

Cover notes are a very outdated term and it could be if you used that language the 17 year old in the call centre just didnt know what you were talking about.
If you say that you want to add a temporary additional vehicle for a garage provided courtesy car then I'd be highly surprised if they said no0 -

yeay i'll try that - but you think they will charge?0 -
They probably will charge but will you actually get the courtesy car back. You'll need to know the exact details of the car to get it added as a temporary vehicle.0

ok so i went back to my new insurer and this is what they said: You are automatically covered to drive a courtesy car that is loaned by you by someone of the motor trade if yours is in for service, repair or MOT. Cover is the same as the cover you have for the Toyota so it would still be comprehensive tooYou do not need to give us details of the vehicle but if the garage want to see confirmation of what I have stated here; it is on section 1b of your certificate of insurance.
so then i called the repair people to see if they had one available. apparently they said that in my old policy my insurers only entitled me to a couresy car whist that policy was valid. so they cant give me one0 -
Check your old policy or speak to your old insurers and ask them to point out where exactly in the policy wording it says this.0

supply a temporary replacement car while the repairs to
your car are being carried out, if you use our network of
selected repairers.
We will insure the temporary replacement car under this

and you will only have to pay for the fuel used. You must
return the temporary replacement car when the owner or
we ask you to or if this insurances expires and you do not
renew it.
Temporary cars are usually small hatchback under 1200cc
I called an asked insurers where it says in policy, i was then put through to someone else who said they would speak to the repairers about getting me the car but i may have to provide a cover note. i said that when i asked my new insurers for a cover note a week ago they said no. but the online chat advice infers that i am ok to be insured on the vehicle. i was then told they would get the repair company to call me........ NO MANS LAND!!!!
