'Expect to be shot if you burgle gun owners', judge warns criminals

A judge has defended the rights of people to protect their homes, telling two burglars shot during a break-in: “That is the chance you take.”

Joshua O’Gorman and Daniel Mansell were blasted with a legally-held shotgun after they smashed their way into the isolated rural home of a businessman, Andy Ferrie, and his wife Tracey last month.

The two men, who have a string of convictions between them, were arrested when they arrived at hospital seeking treatment for their injuries. Mr and Mrs Ferrie were also arrested and questioned for more than 40 hours on suspicion of causing grievous bodily harm. They were later released without charge.

O’Gorman and Mansell appeared at Leicester Crown Court where they were both jailed for four years after admitting burglary.
In a move welcomed by justice campaigners, Judge Michael Pert QC, told the pair they could not expect any leniency simply because they had been wounded in the incident.

He told them: “If you burgle a house in the country where the householder owns a legally-held shotgun, that is the chance you take. You cannot come to court and ask for a lighter sentence because of it.”

    No Hamish. The Common Sense to which you refer is in England.

    If you want common sense in Scotland, you will have to talk to that nice little rotund Mr Salmon and get him to legislate for it.

    I think the point was that the burglars asked for leniency on the basis that they'd been shot in the aris. The judge said no.

    He isn't saying they should have shotguns 'to' protect their homes he is saying what the judge said was common sense, that those who burgle people who happen to already own shotguns should expect problems. In answer to your question:

    I wonder if a small part of the decision making process should be an analysis of online social networking platforms.

    Owners of accounts who "go off on one" with abusive and threatening behaviour towards, for example, politicians, minor celebrities and banking institutions, really shouldn't be given guns.
    A mood swing with a keyboard is very different to a mood swing with a shotgun.

    I'd have thought the gun licencing people would be the ones who decide who can have a gun. That's probbaly me being "bullish" again.

    I think it's great that the bloke didn't get charged for shooting them.
