Tax calcs for previous employment come back to haunt me

Hi

I've had a letter through from the tax man funnily enough asking for more. They reckon I had a benefit in kind at my last employment that should of been taxed - the only thing I can think off was health insurance, which annouyingly I never used or asked for, but I get the tax man is not concerned with that.

In with this calc came and advice sheet, which had a statement saying "if you think your employer has made a mistke or not taken reasonable care to operate the correct tax code, they may have to pay it for you."

Know what I want to know is

a. can I find out exactly what the benefit was to confirm my suspisions
b. do I stand a chance of claiming they have been negligent?

Ian

Did you get a P11D form off your employer, this details your benefits?

Probably best posting on "cutting tax" board.
  • Health insurance is a benefit - so if you had it your tax code would have been lower. Mine is £950 per year, if it is around that, then it's a good guess it's your PHI
  • No I did not get a P11d, unless they mailed it out after I left and had moved flat, which would be a whole year on.
My tax code being lower would me that the tax man would need to calculate this code right? Whose responsability would it of been to inform him? Is that what the P11D form would of told me to do?
  • I am Going to put this on the cutting tax forum, thanks
