Re ESA letter from DWP

Hi

On ESA since start of 2012. ATOS medical August. Letter today stating awarded 0 point ( letter from Jobcentre plus) and also a letter from same saying cannot pay me ESA from September.

Decision maker listed reasons fro stoping ESA. I feel that many of the points were twisted and because I stated that I wash, dress and attend GP alone and now and then have to go to local shop. Deemed I can cope etc. I am on medication for depression and anxiety and peior to all this always worked full time.

Also because I made eye contact and was talkative ( I was nervous and babbled). I have to do some tasks at home as I am on my own. Does not represent the way I feel or can be.

1) Do I write a letter and point out reasons for appeal due to see GP next week and have sent fit notes continuously since day 1. Does it have to be on a set form.

Am on HB and CT benefit will all that stop now.

Feel so low with it all letter states if I claim jobseekers have to participate fully at present am not up to this.

Letter states can claim jobseekers and fully particiapte and this will not affect appeal.

I am confused with it all.

Sorry to ramble also its based on tax year 2010 to 2011. Have been on contribution ESA will I get jobseekers. Whilst appealing do you receive any benefit.

    While appealing you will get the assesement rate of ESA. You will have to continue to send in fit notes while this is happening.

    You should phone the number on the letter (prepare to be listening to Four Seasons for a long time) and request the information they have as to why they came to this decision. A form will also be sent if you tell them you are appealling and this should be filled in and returned within one month.

    You're far from alone and have a decent chance of overturning the decision.

    As above.. sicknotes in with appeal and should get assessment rate ESA and remain on ESA as opposed to making claim for JSA which is also possible. You can appeal using a GL24 form available from DWP (and can download online and print) or otherwise in writing a letter stating the decision you're appealing and details of why it is wrong.

    I understand that local authority may automatically get tipped off of your losing ESA which is apassporting benefit for the benefits in question. You could however claim because of low income.. so contact them as necessary.

    Thank you will start appeal. Managed to speak to DWP today eventually and wont stop money immediately as have month for appeal although letter staes money will stop from a date in Sept and letter dated this week sept so not quite sure for when month starts assume will be date of letter. will check re HB and CT.

    Wish could be better and just get a job again, made to feel so bad when first time ever after working 30 years have had to claim a benefit and thats with bringing up 2 kids by myself as well.Been an eyeopenener and really feel for persons so much worse than I am going through such a system. Thank you for your help.
