MBNA charges 2001-2006. Can I claim?

Hi
I’ve read through MSE’s Credit Card Reclaiming article. I’ve received my SAR details from MBNA which shows charges for the period 2001 – 2006.
I’m a little confused as to whether I can claim as the MSE article contains the following text stating that I “can go back six years” as shown below.
Step 1. Find all your charges and add them up
You need to find all the fines you’ve been charged by each credit card. You can go back six years in England and Wales or five years in Scotland; these time periods are limited by law.
But further down the article it states:
Step 3. Write to your credit card company and ask for your money
“…Charges from before June 2006. Credit card charges from before this date…”
“…Charges after June 2006. For any charges on or after June 2006…”
Does this mean I can claim all of my charges back to 2001 or could I only claim back to 2006?
Thank you in advance for any help.
Kind regards
Malcolm

As per step 1, unfortunately not.
(it's a step by step plan of attack!)
If you notice that the article was last updated 26 Jan 2009, that should explain any confusion you may have with regards to step 3.
You may, however, wish to enquire of MBNA as to what possible valid purpose they are continuing to hold personal data on you for from 11 years ago.

Thanks for your reply YoYoY.
It thought I wouldn't be able to claim.
And I guessed the reason for the dates confusion was because the article was a little outdated.
Thank you again.

You should still follow YoYoY's advice and ask why they still hold personal data on you from 11 years ago.
On the face of it, this sounds like a breach of the Data Protection Act that states such data should not be retained any longer than absolutely necessary.0 -
Thank you all for your advice.
Maybe in this case its a good thing that they have kept my details for longer than necessary as it's allowed me to see that i did have charges.
I have been reading a lot on other websites about people making claims for charges olde than six years using the Section 32 Limitation Act. Is this still valid? I fully understand that i may have to go to court to make a claim. Has there been many stories of success?
Also in general has there been any update if it is going to be possible in the future to claim charges older than six years?
Thank you again in advance for you help.0 -
They may quote the limitation act and time bar it. You need to complain about it within 6 years or 3 years from knowing of the concern.
Or they may quote the data protection act and state they no longer hold the records.0
