eBay dispute

Hoping someone can help, I purchased an item off ebay and when it arrived it had not been sent via the method I had paid for. I have contacted the seller asking for the difference between the two methods to be refunded to me.
She did not get back to me so I open an ebay dispute via the resolution centre.
She has replied today stating that she acknowledges that she made a mistake, but that she would not refund the difference.
What happens next? I now realise I can't open a PayPal dispute as I already opened an ebay one? But I can't see what I do next, is it just tough luck?

  • I assume you have opened an ebay dispute for not as described.

    You escalate to a claim after 8 days, ebay then make a decision (usually telling you to return it tracked for a full refund, if the case is found in your favour).

    Not sure a postage difference will count as 'not as described' though.

    No - unfortunately I don't think is a legitimate reason for an item being not as described. Even if eBay do find in your favour you will have to return the item tracked at your own cost - not really a good idea as then you are even more out of pocket.

    It happens, it is a nuisance, but the people who do it are not likely to respond to requests for a refund of the overcharge, so unfortunately all I would do is reflect it in feedback and move on. Stupid person - exposing herself to poor feedback - why not just refund if she did make a mistake - but you do have some recourse here, just not an awful lot that doesn't compound the problem.

    I'd just leave a factual neg (e.g. "seller charging for special deliviery but only sending 2nd class") and low stars, then move forget it. It only takes 1 person reading the neg to not buy something and they've already lost more than they saved!

    I will wait the eight days and then escalate, but I won't hold my breath. I just feel she did it as the item didn't sell for as much as she wanted, oh well, can't even say I'll be more careful in future as you do have to put a certain amount of trust in sellers, I will ensure my feedback is factual

    I've noticed a lot of sellers doing this under the protection of "free" P&P - advertise 1st Class or 24hr courier but actually send 2nd or 3-5day service. It annoys me, as you can't leave stars for P&P when it's "free", and it's not enough to warrant a case but you don't get what you paid for (in the item price), and it may have been the deciding factor in your purchase between two competing sellers. :mad: Rant over!

    I never understand why they don't go for the lowest option; you can't really disappoint then (although I am sure there will be someone upset that they got a better service than they paid for.) I don't do free P&P (I'm not a trader) but I do P&P at cost. Sometimes I overestimate, sometimes under. If it's over by more that about 50p, I refund it.     Sorry I am on a bit of a rant about overcharging for P&P; I've just had a parcel from someone. I asked if they would combine pre bidding on several of their items. They said yes so I bidded and won a few items but when I got the combined invoice they'd essentially only knocked a few pence off and it came to £6.00 instead of £6.90 or something. I'd take that on the chin but the actual cost of posting: £2.20, and wrapped in a single layer of brown paper that's was torn right open when postie handed it to me. Bit frustrating because I doubt there's much I can do about it; goods are ok (thankfully).


    Would the OP not have a good case to win based on the sale not being as described? I know the item is but if the postage corms part of the sale - and therefore the contract between buyer and seller - I would think it's relevant?

    Ive listed items expecting say £20 - and stated 1st class recorded. It then sells for £3 - but i still have to send it recorded - as daft as it is - to avoid dealing with petty buyers.

    Op as still avoided saying the cost involved - and how this affected delivery times.

    If it was second class instead of first - and you got it later than stated, then fair enough. But if it was a similar delivery time - then who really has this much time on their hands?

    If, as you state, the item sold for less - then surely you are lucky and got a bargain?
