Pedestrian hit by biker - biker trying to claim from pedestrian

quite a jump
I don't see any mention of road layout, traffic, conditions etc
The OPs girlfriend could have been coming out from behind stopped traffic for example
So the biker has a far lesser warning.
She was crossing from the pavement with nothing to obscure the bikers view.
She has no intention of trying to claim compensation for herself. She just wants to put the whole episode behind her. It seems to me like the young biker is just trying it on to claim some compo for himself.0 -
Quite possibly the biker originally put in an insurance claim to get his bike fixed, and its been referred by his insurers to a bloodsucking no-win no-fee shyster law firm0

I have no idea who is negligent and I would also not be relying on what is said on this forum nor would I make any assumptions. This needs to be treated with care.0

okay,so what obscured her view?
I'm not having a go,simply throwing both sides up0 -
I thought a pedestrian always has 'right of way' on a road anyway irrespective of what traffic lights are set at. The bike should have been going at a speed where it was able to stop safely in an emergency and at a junction that should have been very slowly. I think your gf should lodge a counterclaim with the biker for her injuries/inconvenience or whatever else you can think of.

Or he could be facing a large bill for damages which he can either pay for himself or go through his insurance co, putting his premiums up, and wondering why he should be out of pocket because a pedestrian failed to see him? I'm guessing that this didn't happen on a pedestrian crossing as there is no mention of a green man, only a red light. Some people see a red light and assume it's safe to cross without actually looking first, I've seen it happen several times.
To suggest that the biker must have been speeding doesn't really make sense, your OH was only half way across the first lane when she was hit, the bike would have had to have been traveling at a ridiculous speed to have hit her and she would not have escaped injury free.0 -
Don't think anyone's asked yet but what action did the police take?PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0

OP, one thought occurs. If she was taken to hospital, was the incident not reported to the police? Surely, a personal injury accident they should have been? Or is that not necessarily the case. If they did attend, a police report would be crucial in her defence as this would show she crossed believing the light to be red and, sometimes an accident is just an accident.
EDIT: was writing this as Tilt posted. great minds again."So long and thanks for all the fish" :hello:0 -
Can you just summarise if this is correct?
She crosses the first lane of the road when the green man is on, gets to an island and then steps off the island, but there is a separate set of lights that control the traffic flow for that lane, the lights for that lane being green for the traffic?0 -
