I am sorry i didn't mean to offend you & I really appreciate your comments. Its just Im getting conflicting info & I am stressing myself out over all this.
I deeply regret not appealing for just being transferred to the wrag group withought a medical now. I was meant to be assesed again after 6 months but that didint happen & now it looks like I will end up with nothing.0 -
I've just had my appeal accepted and my last medical was april/may..
I should also be in the SG but i'm on IR so it doesn't matter to me as much as others, but I'm sick of gettong assessed every 6 months so hence the appeal. [it's in the hope i'll get left alone a little more]
I fit into the sg under 'risk to myself and others' I believe it's section 29..

I was transferred over from incapacity benefit last November. I had no medical & was put straight in the wrag.
Now my year is almost up & I will no longer be entitled to contributary based payments & as I receive a occupational pension of £118 a week its doubtful I will recieve income related esa.
This is a big amount to lose every month & I honestly dont know how me & my daughter will survive.0 -

Honestly, I assure you that I wasn't offended and no apology is necessary. It's always possible that posters on this forum are well meaning but accidentally give wrong advice, it's just the nature of an amateur advice forum. I'm fairly clued up but get info wrong occasionally.0 -
Lulugirl, did you ever notify DWP about your occupational pension? Sometimes these are disregarded for people who also had their pensions disregarded under IB. Otherwise, even for contributary ESA, there is a 50p reduction for every £1 above £85. I would hate you to suddenly be faced with a repayment demand at a later stage!0

I honestly dont know. I have never hidden the fact that i received a occupational pension. I have been on incapacity for 15 years before i was transferred over to the wrag group & i was never asked for a medical. I have always declared it when asked for tax credits ect but I have never been asked to fill another form on incapacity as I was exempt.

Yes but you'll surely get housing benefit, tax credits, and child benefit..
I would have thought it would be awarded on one hand and taken back on the other , [income related]
They will have to award something otherwise you won't have an entitlement to your rent or CT..
Talk to you advisor at the JC, and i'm wondering if you are due a medical assessment soon as if so this would enable you to start an appeal if still in the WRAG..I always take the moral high ground, it's lovely up here...0 -
I have a mortgage so no help with that unless I can get income related esa & no help with council tax. I must be due a assesment soon so I will just have to appeal like I should have done in the first place & ask my pychiatrist to back me up.0

OP, I would consider going to CAB to get some help with this as it is quite complicated.
1. Your query about appealing ESA - they will be able to tell you whether you can do this.
2. Your query about your pension and contribution based ESA.
3. Your query about income based ESA and your pension.
I believe that there is a 'linking rule' which means that if you do not get income based ESA because of your pension then you would still be able to claim CTB and housing costs (where the interest on your mortgage is paid )
Do you get an income related 'top up' to your ESA? Look on your paperwork.
If you did then I would have thought you would have been entitled to housing costs.
Mmmmm - as I said complicated.
Get an appointment with CAB. Take along all your paperwork and proof of income (bank statements, letter awards etc and details of your mortgage)
Something doesn't sound right here.0
