Car accident, jargon

I had a car accident in july. A taxi, didnt stop at round about, and went into front passenger side. I werent going to fast, more like 10mph. My car has been repaired, and im having physio for whiplash. Today i received a letter from my insurance company saying "received correspondance from third party insurers, who have advised that they have indemity issues ongoing and they will revert back to us once these are complete" Can someone please explain in plain english, as to what this actually means.

  • The taxi driver's insurance company (Third Party Insurer - TPI) are making enquiries into the validity of the insurance policy as they have some concerns (indemnity issues). It could be issues with payment, undisclosed accidents etc etc etc.

    Once the TPI have completed their investigations they will come back to your insurers with their response.

    Basically means you need to wait a month or so whilst the TPI confirm his insurance is valid. Even if its not it doesnt necessarily mean a claim cannot be made against it but can make the process more lengthy depending on the TPI's general stance on how to deal with these types of issues

    Sorry he might not of had insurance to drive taxi ? His car already had two other big dents in his car, and not caused by me either.
  • There is evidently a question on the insurance - it may be the questions all come back clear and its no problems what so ever

    Even if there indemnity issues then that isnt the end of the road but things do get more complicated and there are a lot of additional questions that would need to be asked (eg do they have a certificate of insurance for the vehicle? was it a fleet policy or a single vehicle policy? etc)

    Dont worry about it until you have to though, most indemnity issues disappear
  • As II has said, these are more delays and an inconvenience than an actual blocker to your claim being resolved.

    It is most likely issues of non-disclosure by the other party, such as previous accidents, whether the policy he was driving on was for an actual taxi, if the person driving was an authorised/ named driver etc etc.

    None of these problems should in the long run prevent you and your insurers from making a recovery of your losses as the bottom line is that as the vehicle in question had insurance and as (i assume) you can name the driver of the vehicle and therefore he can be identified, they have a legal obligation to meet any third party claim or satisfy any court judgment obtained against the other driver.

    All should come good in the end.

    You will be fine, his insurers will still have to deal under the RTA, but will not cover his vehicle if there is any damage.
    Unfortunately as others have stated it just might take a we bit longer.

    Whilst dont want to scare the OP this is a little bit too much of a sweeping statement as there are certainly circumstances where the insurer would not be considered RTA insurer - eg if he was under the understanding that he was covered under a policy to drive any cars but isnt and the vehicle has no other insurance in place.

    Even if there is no insurance in place the MIB would be there for the injury claim under the uninsured driver scheme
