Crack in Flashing on Neighbours Chimney causing leak in our roof (Possibly)

Hi all,
Hope you can help.
We woke in the night to the sound of water dripping into the room. The rain was belting down, although it didn't flood in, I don't want any coming in.
So I have just stuck my head up and out of the Velux in the Attic to have a look and I think I can see the problem (pictured and circled below). On the Neighbours chimney there is a small tear in the lead flashing, in almost the exact point where the water is coming in. My guess is that it is going through the gap and then under the gap where our tiles meet the neighbours - its hard to see in the picture but that tile that comes from under the flashing is slightly higher than the rest and so there is a slight gap.
As you can see in the picture the crack seems to be almost right on the border of the properties, but that is their chimney stack. So who is liable for the repair? We live in a 3 story house, so we are effectively 4 levels up once we are at the site of the chimney and I really don't fancy going up there even for a temporary fix. Equally I don't want to be landed with a big repair bill if I don't need too.
Can anyone offer any advice on how I should proceed?

Hi,
What has happened since? We are having the same problems in our maisonette, the water is pouring in through the roof and causing damp on our landing wall. The roofer confirmed it is the lead flashing on the neighbours chimney that is causing the leak to come through our roof. They said theywould look into it, but how do i go about claiming for the damage?0 -
Looking at the pictures one roof looks newer than the other looking at the moss coverage and the slates and the crack/slice looks to be where the newer roof joins the older roof. Has either roof been reroofed?0
