flat pack furniture

I ordered a wardrobe for my daughter on 17th august. i ordered it over the phone and it was delivered on the 21st.
since building it i have had numerous problems.
The feet don't fit properly.
The drawer fronts are held on with dowels and glue but the glue supplied is pants and when you open the drawers the fronts come off. The drawer bottoms are made of really flimsy ply wood so you can't put anything heavy in them.
When you look at it you can see big gaps between all the drawers (there are 7).
The door doesn't fit.
(The wardrobe had pre drilled pilot holes for all the screws and dowles.)
I am not happy and i want to send it back.
I contacted the company and they have said that their T&C say that once a product is build they do not except returns. However all the problems have come to light once it was built.
They have also said that they have never had a problem with this particular wardrobe therefore the problem is mine not theirs and they are not at fault.
We seem to be at stale mate and i want to know where i go from here. Am I stuck with this wardrobe or am I entitled to return it?

    Stating that once a product is built they do not accept returns could (depending on how it is worded) be an unfair contract term and thus unenforceable. In SoGA and DSR you have the right to see whether the goods conform to contract. There is no possible way of doing this when they aren't built so effectively, if the term is as simple as "no returns on built units", they are depriving consumers of their statutory rights - and misleading consumers about their rights can be illegal.

    Do they have a website with their terms and conditions posted? Could you link it to us please?

    I know you received it on the 21st but when did you first contact the retailer and let them know there was a problem? And not to be cheeky but I have to ask, is there any way any of the faults could be down to incorrect assembly? The bottom of the drawers being flimsy obviously isn't due to assembly, but what about the other issues? Please dont take offence to the question, just trying to rule out other possibilities.

    I hate to be the one to say this, but i don't think you can return the wardrobe.
    We had a similar situation with our kitchen.
    One of the things our solicitor told us, was that we couldn't return the kitchen to the company in the same condition as it was delivered to us, because the problem didn't come to light until we had built half of the base units.
    Under the sale of goods act you have a reasonable amount of time to return the product....but once its altered they take a different view.
    I wish you luck in what ever avenue you take... i'm afraid the only thing which might work is a letter to the MD of the company, they don't like to be bothered...

    I think assembly would symbolise acceptance but wouldn't effect ops rights to 'remedy'
  • I've just returned a load of flat pack stuff back to Argos after 3 months because it was faulty, soga still protects the OP even though the wardrobe is built as long as they followed the instructions when constructing it. Even though only part of my order was faulty, Argos accepted the return of other matching items and let me swap for more expensive furniture for no extra cost but they did try and tell me I had to dis-assemble all the furniture and repacked in the origonally packing which was never going to happen.

    This is pretty much a standard way of doing things. The glue supplied is usually water based & and useless. I never bother with it. Ask in a DIY store for the solvent based Evostick. Because it's solvent based they will only sell to adults and flat pack furniture won't include it in case it gets into the wrong hands but it will stick properly.

    Unfortunately this is often the case. Plywood is better than some boards that some manufacturers use.

    This is pretty standard. Sorry to ask but are you 100% sure you have the right parts in the right place. Sometimes a left and right panel can be almost identical but the right can be fitted upside down in the lefts place etc

    Doesn't matter what their T&C say. You are saying the goods are not fit for purpose and it is up to them to prove that they are.

    Customer services usually tell me that they have never had a problem with whatever I have a problem with. In this they are saying there has never been a problem so there could never be a problem. Which is illogical just because they have made the parts OK before doesn't mean a manufacturing fault can't occur.

    The Which website has some example letters. Modify one telling them you believe the wardrobe is not fit for purpose and ask them what their proposed remedy is.

    i followed the instructions to the letter and there is only 1 way to build the drawers because there are grooves where the runners go.

    Hmmm...

    I think you perhaps mis-understood Fred7777's last sentence.

    I believe he was pointing you towards the Which website... where you will find sample letters...
