If you mean legal proceedings - no. The insurer will take the details and advise further. If the driver is not part of that policy, it becomes a MIB matter as an uninsured driver.
Not if the driver is identified and there is a policy on the car, the RTA will make the Insurer of the car liable.
In the above circumstances the MIB will not be interested0 -

Lee has already admitted to working for a claim handler, hence his biased advice to go straight to one!
You may find that the third party insurer will bend over to help you if you follow the advice in #3, and first contact them and enquire about them taking over your claim direct.
Ask for a replacement car whilst they determine what to dio about yours, or finalise a settlement.
Keep all receipts and records of all your expenses incurred and when this is resolved send in your bill (inclide the costs of tracing them too).0
