Claiming back increase in premium after no fault claim

Hi -

Scenario: Driver (a) goes into back of car (b). Policy holder of b claims off of insurer of A. Insurer of A admits liability.

Upon insurance renewal, B's premium is higher. Can B claim back the difference from A's insurer?

  • Generally speaking, no.

    The reason for this is that it is nigh on impossible to get a clear answer out of an underwriter as to how much of a loading is being applied due to the non-fault incident, which is the evidential proof you would need to succeed with this item of claim.

    You could try running two quotes with the only difference being no accident being declared and see what the difference is.

    Are you certain all your NCD has been allowed? Did you claim directly from the insurers of A or did you still use your own fully comp cover and incur an excess?

    If I run the quote without the incident, it is one value, if I run it with the non fault claim, it is a higher value. That's a pretty clear loading in my opinion.

    My NCD wasn't affected. I would never claim off of my insurers where a third party admits liability. Makes no sense, and always easier to claim direct in my experience.

    So, can I claim back the difference from driver A's insurers?

    Nothing to stop you claiming, though unlikely to get you anywhere. (Speak to a claim handler/solicitor/your insurance legal helpline and get an authoritative reply)
