New 100% biodegradable Nespresso-compatible capsules?

We have a Nespresso machine which we bought in Switzerland (they're everywhere there). I was against it at first, mainly because of the waste, but credit where it's due to Nespresso - their recycling is pretty good. They even recycle the used coffee. (they make a big marketing hoo-hah about this without mentioning that only 3% of all capsules are ever returned for recycling...)
A friend worked for Nespresso so I have learnt a bit about the product. One of the interesting things is how they protect the design - the patent is on the method whereby the steam pressure breaks the seal around the coffee. This is why all 3rd party capsules are vacuum wrapped, to avoid this.
At least, that was until I found these today: http://www.ethicalcoffeecompany.com/ . They claim to be 100% biodegradable and fully compatible Nespresso capsules. The compatibility I can vouch for after buying a packet of them today.
What I'm curious about is how these are not in trouble from Nespresso; they appear to work in exactly the same way - pressure piercing included - and to counter the odious "Nespresso Club" warning that 3rd party capsules will damage your machine, they promise to replace any machine that is damaged (and apparently that hasn't happened yet).
Given that one of Nespresso's self-admitted barriers to market penetration is the throwaway nature of the product, and the waste it creates, I wonder if this product might become a serious competitor.

This company don't have any sales outlets in the UK. For me, it would still be easier to buy directly from Nespresso.0

Ah, I didn't realise that. Here (Singapore) they only have one, but even that is not listed on their site.0
