Hello everyone i have a dilema i hope you can help me with
I'm currently on sick leave from my job as i'm not able to do my post
I have asked my employer if i can have my redundency several weeks ago and they are processing my application as there are positions that need to go.
I have contacted the HR department and it seems that the process may take a while to eventually go through .
i realise that it would not be correct for me to find a suitable job whilst being payed sick ' But have many options to work for other companies .
Obviosly i do not want to miss out on whats owed to me in redundency pay.
Is there away that my employer can relieve me of my duties and still process the redundency ?

Not if they are genuinely reviewing their structure. Its the post that becomes redundant, not the person doing the work. By all means get another job, but don't buy into the idea that you are "owed" redundancy payment.0

your quite right after i read my own post i thought someone would mention that part about being owed what i mean is i feel i have earned the right to be payed VR0 -

To some extent that depends on why you are off sick. There is no hard and fast rule that says you can't go to an interview whilst off sick. If you are going to do so then I would take the precaution of making sure your doctor is "on side" with the concept.0 -
Redundancy pay is never owed (but I know how you feel when you have given a lot)
It's down to personal discussion.
If you accept a job before your official notice period - you lose redundancy pay. some employers are happy to negotiate this, but it's really between you and them.
If an employer paid redundancy and found out that you later had a job (and hadn't handed in your notice as per normal requirements) they would have the right to reclaim that money.
In short this is something you need to discuss with them because they need to give the green light or you wait until they serve you notice.0 -

it's not just the sick - it's the fact that you are still legally under contract by your current employer. You need them to release you.0 -

It's not illegal, but you'll have to resign and forfeit any redundancy payout to take the other job.Science adjusts its views based on what's observed.

If your too sick to do the present job, how can you be well enough to do/start another job.
If you have been off sick for a while and you cant carry out your duties, your company could just as easily say 'no' to redundancy and then a few weeks later, if you are still unable to do your job, then get rid of you on capability grounds. It happens and it would save them paying you any redundancy at all.
So if possible, I would get back as soon as youre able to be honest.
How long have you worked there.make the most of it, we are only here for the weekend.

I will be moving from a manual job to a non manual job
i currently have around 7 years service0 -
Do you have a new job secured then.
Even if they made you redundant, they would have to give you 6/7 weeks notice which they may make you work (or be on the sick for)
I'm getting the impression that you think jobs are so easy to come by or you already have one to walk into.make the most of it, we are only here for the weekend.
and we will never, ever return.0
