No, legally the employer has to pay whatever they have contractually agreed if this is more than SSP.
When somebody is signed off sick they are certified as being unfit to do their particular job. There can be situations (OK it is unusual but it does happen) where somebody has more than one job and is signed off sick from one but is OK for the other.
An employment contract may (and quite often does) restrict what other jobs you may have or require you to obtain permission. However, not all do by any means.
So, it is perfectly possible that the OP could legitimately be off sick but fit to work elsewhere.
I agree that the employer probably won't like it and will look closely but it may be OK under certain circumstances.0 -
