I don't think there are rules prohibiting alcohol as prizes in Scotland I think M&S may be misinterpreting the law. Must go and do a wee search.
The only thing I can find is a section stating that it must be restricted to sealed containers - "

• offers alcohol as a reward or prize, unless the alcohol is in a sealed container and consumed off the premises.

I've tweeted them and Facebooked them for legal clarification I think they may be confused with proposed legislation as opposed to passed legislation.


I suppose I could always pop down to Carlisle and trolley dash there if I won!

M&S responded to my Tweets and Facebook message about the legal situation in Scotland regarding promotions including alcohol. Their replies follow...
I've just heard back from our Legal team. The trolley dash in store is permissible in Scotland, but all alcohol must be in closed bottles and for off sales only. Promotion of the prize (because it involves alcohol) can only be advertised/promoted within the store licensed footage. I hope this helps.

Nice to know they checked this and amended the Ts and Cs. Although the comp has already closed - just hope somebody from Scotland can take advantage of the revised Ts & Cs and stock up for Hogmany
