Second hand PDA with pre-installed TomTom

I recently bought a second-hand PDA on eBay and when it arrived it hadn't been hard reset so it still had the previous owner's files etc.
I'm keen to hard reset the device to have a fresh start, however, there is a copy of TomTom installed on the device and the SD card which came with it.
I presume that if I perform a hard reset then I will lose this TomTom software since I didn't receive any disk to reinstall the software (it wasn't advertised as being part of the item on eBay and there wasn't any mention of it being installed on the device). Is there any way around this, and how do I stand from a legal perspective?
Thanks!

Well from a legal standpoint if you don't have the original disks/license for tom tom then running it is more than likely piracy.0

Ok, thanks for the advice. I already have a licenced copy of the AA GPS software on my old PDA so I might as well transfer this to the new PDA - it's just a shame since the TomTom version was newer!0

The TomTom licence is usually locked to a device and therefore if it came with the device, and the original owner doesn't change the licence from the old PDA (yours) to another, then it's yours.
Having said that, without the installation media (unless it's a self-install SD card) if you hard-reset you've lost TomTom.- = I also recognise the Robins and beep for them = -0
