Paid by Paypal for non-eBay item. Seller didn't send item. Can I claim my money back?

  • I'm sure I am right in saying that the fact that the seller has closed his paypal account will make no difference to your claim.

    Paypal will refund you and then pursue him for the money.

    Someone will be along to confirm this shortly

    When the case is found in your favour, Paypal will refund you your money, then chase the seller for the funds.

    As the seller has closed their account, they wont be able to reply to the case, Paypal should then automatically find in your favour.

    As the refund will fail from their account, it will be interesting to see if you get this same email from Paypal, telling you to sort it out with the seller while still processing a refund.

    Hi OP don't worry if you do get that email from paypal your refund will still go through this link is to my post and i was really worried but everything went through fine so take care and don't lose any sleep;)

    Many thanks guys. That makes me feel better. Thanks for the link Supermum and No Eye Deer ;-). It didn't start so well for you Supermum but at least you got your money back in the end so hope it will be the same for me.

    I'll obviously keep you all updated so as to give guidance/assistance to scammed buyers paying via Paypal in future. Thanks for now.

    Hi everyone.

    As promised, an update. I received this email on Friday and it's good news:

    ''Dear xxx,

    We have concluded our investigation into your case and have decided in your favour.

    We were able to recover 750.00 GBP, and this amount has been credited to you. Please allow 5 working days for this adjustment to be posted.

    If you are due any additional funds, we will make our best effort to
    recover the balance from the seller.

    If the seller's account has insufficient funds to complete the refund owed
    to you, please be assured that we will take appropriate action against the seller's account, which may include limitation of the seller's account
    privileges.''

    I logged into my PP account and the money was immediately refunded to my CC on Friday after reading the email from them, though it hasn't appeared yet on my CC account but I'm hopeful that will appear soon?

    I'd just like to thank you all for the assistance ;-). I also hope this will be of use to others in future. What a massive weight off my mind - I actually feel like celebrating! Still, it's a terrible shame there are such individuals who do this, and so I hope the guy in question will be investigated and dealt with in the same manner as an individual defrauding someone in person rather than simply only having to pay back the money which was due to me, and the others he attempted to defraud. Any chance of that?

  • the exact same incident has happened to me. I paid for an iphone 5 outside of ebay as the seller told me he would accept an offer of £490. I pad for the item instantly on saturday and he said he post out monday. however when it got to monday he didn't respond till later and said the transaction was under review which was total !!!!!!!!. I should have suspected him then. I phoned up pay pal that night and they told me the transaction had gone through to him and I had paid.

    I sent the seller another email telling them if pay pal had released funds to them and they said all was fine now and they would send out the phone first thing in the morning.

    I emailed them the next afternoon asking if they had sent out the phone and if they had a tracking email, guess what no response at all. I sent them several emails after asking the same thing but no response.

    I waitied till the next couple of days and on the wednesday I phoned up pay pal opening up a claim from him as I have not received the item from him yet. It's now thursday but still no response at all from the seller.

    pay pal sent me an email telling me the case will be reviewed in 10 days.

    my concerns are that the seller has probably deleted their pay pal account and withdrawn the money to a bank account. If this is the case how will I get my money.

    Is it possible pay pal refund the money?

    I'm thinking about phoning them up to tommorow and telling them my concerns to see if they can refund me now.

    I'm so worried about this. Not been sleeping at all this week. i don't work and £490 is a hell of a lot of money to me. If I lost the money I don't think I would get over this. I'm so worried.

    Could anyone put my mind at ease.
